業務委託契約？ - 委託、委任、準委任、請負の違い

委託、委任、準委任、請負をそれぞれ英語で説明してみました。

委託契約、委任契約、準委任契約、請負契約。英語で言うと以下のようになります。

えっ？全部同じ？そうなんです。英語だと区別がないので、言い分けが必要な場合は、以下のようにきちんと説明してあげる必要があります。

委託契約： 取り扱いや実行などを、人に頼んで代りにしてもらう契約			Service agreement There are the following types of service agreements in Japan:
1	委任契約	当事者の一方が法律行為をすることを相手方に委託し、相手方がこれを承諾することによって、その効力を生ずる契約（民法643条）。	An agreement in which one party requests the other party to perform “legal acts” while the other party accepts the request (Civil Code Article 643). An act is a legal act if, by the act, legal subjects can change the legal positions of themselves or other persons intentionally.
2	準委任契約	法律行為でない事務の委託業務委託契約の一つで、特定の業務を遂行することを定めた契約（民法656条）。	An agreement in which one party requests the other party to perform “operational acts” while the other party accepts the request (Civil Code Article 656). An act is an operational act if legal subjects can change the legal positions of themselves or other persons without an act of will on the part of the one who performs it.
3	請負契約	当事者の一方がある仕事を完成することを約し、相手方がその仕事の結果に対してその報酬を支払うことを約することによって、その効力を生ずる契約（新632条）。 請負契約は、仕事の完成が、契約内容となっている。	An agreement in which one party agrees to complete a work while the other party agrees to pay a fee for the completed work (Civil Code Article 632). Unlike the above two types of contracts 1 or 2, this agreement requires the completion of the work.
